HUNTINGTON BEACH, Orange County — October 23, 2026. A beachside investment listing may look attractive on a nightly-rental calculator, but the address determines which short-term rental rules apply. Under the City of Huntington Beach’s official Short-Term Rental rules, the city is divided into Zone 1 (all city areas except Sunset Beach) and Zone 2 (Sunset Beach). Owner-occupied, hosted rentals are allowed within the city’s permit framework in both zones. Unhosted rentals have a much narrower historical permit pathway in Zone 2.
Can I rent out a whole empty house?
Huntington Beach says unhosted, or owner-unoccupied, rentals in Sunset Beach are permitted only for qualifying operators who obtained the required authorization under the original March 1, 2022 deadline. A buyer should not assume an existing owner’s nontransferable permit automatically follows the house. Check the permit and municipal code directly before valuing a property on projected vacation-rental revenue.
What counts as a short-term rental?
The city’s rules apply to residential stays of 30 or fewer consecutive nights. They require a city-issued, nontransferable short-term rental permit; the permitted number of rentals per property depends on the property type, including separate rules for multiunit ownership properties and condominium restrictions. Homeowners associations can impose additional restrictions within the bounds of law.
What about existing ADUs?
The city notes that a legally permitted ADU or junior ADU could qualify under its ordinance if the unit was legally established before the ordinance’s effective date. A newly built ADU does not automatically create a legal vacation rental. Confirm the unit’s permit history, the primary residence’s occupancy requirement and any separate local limits before listing it.
Taxes, local contacts and fines
Operators must designate someone available 24 hours per day who can respond to complaints within one hour, comply with noise and no-event requirements, display their municipal permit number in advertisements and remit required taxes and assessments. The city’s guidance lists a 10% Transient Occupancy Tax and a 6% Tourism Business Improvement District assessment. The city also warns of daily penalties and possible permit revocation for repeated violations. Fees, tax assessments and enforcement practices can change: use the live city guide rather than a years-old vacation-rental blog.
What should a renter or neighbor do?
Huntington Beach provides an issued-permit list and Code Enforcement reporting instructions. For alleged violations, the municipal information page gives 714-375-5155. In an immediate emergency, call emergency services instead of making a routine rental complaint.
